The rescued diaries are below, but I’d like to tell a story before we begin.
You can really tell that the Republicon talking points on the EFCA have been working when your own union leadership starts parroting them. A few days ago I was at my local union meeting when our regional director said that EFCA was taking away the secret ballot and replacing it with card check. I corrected the director, saying that “the employees still get to choose to have a secret ballot election if 30% of them want one.” He said “No, that’s what they have now.” We went back and forth on it for a little bit, but I didn’t want to argue with him in front of everybody (especially when we had more pressing issues to discuss), so I let it go and promised myself to look up the law later.
So I did. EFCA is an amendment to the National Labor Relations Act. What is being amended as far as voting goes is section 9(c)(B) of NLRA, which gives management the right to petition for an election after the registration cards have been turned in. Section 9(e) is the section that gives employees the right to request a secret election after the union is certified. Section 9(e) does not prevent certification of the union, but decertifies it after the union is recognized. Therefore, the workers still have a right to request an election if they feel they should not be unionized.
If you hear your union leaders spouting off nonsense about EFCA, make sure to correct them. Name dropping sections of the NLRA will get you some respect amongst the union leaders, too:).
