This has been reported for several hours, so I'm quite surprised to see no diaries in the last 12 hours on the war between R2K and DKos.
Greg Sargent of the Washington Post has a good account of the suit, which was filed late yesterday in the United States District Court for the Northern District of California:

The complaint contains numerous details we haven't seen here yet in discussions.
Here is the story about this from today's TPM:

As with my diary yesterday, I'm acutely aware that many or most of us here read at TPM and/or the WaPo, so this won't be news to many. But I really like having the community discussions here.
And this is a BIG story!
Incidentally, I'm especially fascinated by this because I'm a lawyer. It's very interesting for me to see all the little typos in the complaint, all the interesting little new details, all the details that are deliberately not specified (such as what the actual payments were to R2K, and how that compares to other polling purchases).
I'm very curious about why they went down at one point from 2400 to 1200 respondents.
And so many other things!
I guess we'll have to wait at least a week for the reply from R2K's Big Shark: http://www.howrey.com/...
How would you like to be cross-examined by that guy?
UPDATE: Great to get on the Wreck List!
One thing I found striking in the complaint is this:
- Kos Media LLC owns and operates DailyKos
(http://www.dailykos.com), the largest progressive community blog in the United States.
The FAQ takes pains to call this a Democratic site, not a "progressive" site, and that's a point I make in comments all the time. But AdamB at least wants to describe DKos in a lawsuit that will get national attention as a "progressive community blog." Interesting.
UPDATE 2:
This is like a John Gresham novel. It gets better and better, by the hour. This is MUCH more interesting than a pedestrian Orly Taitz caper, for example.
Check out this, posted a little while ago on TPM:
http://tpmmuckraker.talkingpointsmem...
That's Crazy Ali insanely lashing out at Markos, accusing him of "sinister reasons" and claiming he owes Ali "six figures."
It's just unbelievable that his super hot shot lawyer is letting him rage on like this to the press. I can't remember ever seeing a spectacle quite like this before.
Here is part of his out of control screed:
Let's also be honest here and state that many in this witch hunt are in the tank for the Kos. If they were truly fair and objective, they would allow this matter to go through the legal process. Most importantly, what would they all report if Kos did receive what they wanted? I can answer that, they would two things, first they would find a biased statistician that would find a subjective flaw in the data and two, even if the data met the satisfaction of all, our vindication would be on page 7 in a small blurb in the Metro section and Kos would not even receive a slap on the wrist from any of them. Most importantly, our reputation will never be repaired even after we are vindicated, so in that sense Kos has already been successful.
Time for the tranq gun.
