Ahh the Rec List....
First there was this diary: How to hoist the SCOTUS on their own petards!!!
THEN came this hot-blooded response: Well, F*ck. Has Daily Kos Gone Mad?
The first diary does a poor job explaining the issues.
The second diary also fails to understand the issues, but makes the mistake that the first diary has adequately explained the issues.
To quote Obi-Wan Kenobi, "who's the more foolish, the fool, or the fool who follows?"
Please allow me to clarify. It's very simple. (over the fold, please)
The first diary quotes this little bit of misinformed hooey:
To my mind, however, the first step is pretty obvious. Congress should prohibit any corporation from engaging in this new political spending if it has any non-American shareholders or owners. Because after all, foreigners have no 1st Amendment protections.
[emphasis mine]
Um. Foreigners DO have a right to free speech.
The second diary jumps on this and rants a righteous rant without ever understanding the Citizen's United ruling, or the poorly explained thrust of Diary 1.
It seems really obvious to me, but perhaps I'm just a supergenius?
It's like Diary 1 is saying: "He am go toilet." Not great English, but I know enough to surmise that it means "He went to the toilet."
Diary 2, however, FREAKS OUT as if what was said was "He is a piece of shit!"
What did SCOTUS say in Citizens United. They said Corporations have a right to free speech, and campaign spending is free speech. In other words, Money = Speech.
But where does this NOT apply? To foreigners. Right. US Law prohibits foreigners from making political contributions. Have we forgotten the allegations from "Chinagate" so quickly?
So there's the issue. It's NOT about free speech, it's about MONEY.
So, back to the salient point form Diary 1:
Congress should prohibit any corporation from engaging in this new political spending if it has any non-American shareholders or owners.
Right. Good point.
