Dr. James Dobson bemoans the "liberal stronghold" of the federal judiciary. His press release regarding last week's dismissal of the Nebraska state constitutional amendment described "a marriage-protection amendment ... overthrown by the whim of a federal judicial tyrant".
When this particular "tyrant" was appointed in 1997 by unanimous vote of the Senate, his supporters included such nefarious left wing politicians as -
Allard (R-CO), Ashcroft (R-MO), Brownback (R-KS), Frist (R-TN), Grassley (R-IA), Hatch (R-UT), Helms (R-NC), Hutchison (R-TX), Lott (R-MS), Lugar (R-IN), Santorum (R-PA), and Thurmond (R-SC)
Dr. Dobson's complaints include this one: "`The (Supreme) Court has no checks or balance. They are the final word on everything. They regularly override the other two (branches of government), which was not intended."
The Supreme Court, if I recall my civics classes, is supposed to have "the final word on everything" that is brought before them - that's why it's the SUPREME Court. The Court is supposed to override the other two branches when those branches exceed the limits of the law. And the Court is checked and balanced every time a new Justice is appointed by the nomination and approval process of the executive and legislative branches.
If Dr. Dobson doesn't like the way judges rule on cases dear to his heart, perhaps he should discourage the lawsuits that open the door for those rulings in the first place.
