Martha Coakley, the Attorney General of Massachusetts, is already waging war. As David Dayen at FiredogLake puts it, writing about the lawsuit Coakley has filed on behalf of Massachusetts' citizens:
Coakley is accusing banks of stealing homes. They didn't have the proper proof of ownership to take control of the homes in a foreclosure, and they did it anyway, by forging documents and committing fraud upon state courts.
Them's fighting words.
Kamala Harris, the Attorney General of California, and other Attorneys General nationwide are on the brink of taking arms:
California has pulled out of negotiations with banks to come to a settlement over robo-signing and other foreclosure practices, possibly derailing attempts by banks and the Obama administration to come to a deal worth about $25 billion to the states. California AG Kamala Harris called the proposed deal "inadequate for California homeowners."
#OccupyHomes is calling for a National Day of Action on December 6th (find yourself a local event and join the battle). They put the struggle well:
... because of the foreclosure crisis Wall Street banks created with their lies and greed, millions of Americans have lost their homes, and one in four homeowners are currently underwater on their mortgage...
The Occupy Wall Street movement and brave homeowners around the country are coming together to say, "Enough is enough."
Local organizations like Causa Justa / Just Cause and those listed as allies of OccupyHomes have been fighting the good fight for years now; only recently have their battles come to national prominence.
Only Congress can "officially" declare war, but they haven't used that power in more than sixty-five years. And an Administration riddled with Friends of Banksters has proved again and again that it will not use the War Powers Act take Executive Action or demand Congressional Action against the Banksters.
It's time the people take back the power the Government refuses to wield.
When you purposely nearly destroy the entire US economy, and then profit handsomely from your actions, An Official Declaration of War seems only fitting, no?
Here's my attempt. Try constructing your own, based on one of the other ten Declarations of War Congress has passed since 1792, or from scratch.

Declaring that a state of war exists between the Bank of America, Citibank, JP Morgan Chase, Wells Fargo, Goldman Sachs and other similar institutions (hereby known as "The Banksters"), and the people of the United States and making provisions to prosecute the same.
Whereas the Banksters have committed unprovoked acts of economic terror against the Government and the people of the United States of America:
Therefore be it Resolved by the people of the United States of America in General Assembly gathered,
That the state of war between the people of the United States and the Banksters which has thus been thrust upon us by their total disregard for the welfare of their country is hereby formally declared;
That the people will hereby employ their economic, political and social resources, along with their constitutional rights, to carry on a struggle against the Banksters; utilizing boycotts, occupations, foreclosure and eviction prevention actions, civil disobedience and all other consitutional means to bring the fight to their doorsteps; and,
To bring the conflict to a successful termination, all the resources of the people are hereby pledged; we will not be satisfied until the trillions upon trillions of dollars taken, and the untold human suffering caused, because of the actions of these Banksters, is recompensed, redressed and justice has been served.
