The first thing someone in Wisconsin should do is file a public records request for any emails to or from Kathy Nicklaus in which the words "Prosser," "Brookfield," "Access" or "election" appear. You may think of some other words that should be included.
Someone should do that at the start of business on Friday and hound the appropriate officials to make sure the request is answered within the timeframe specified by Wisconsin law (for lots of states, this is about three days).
In fact, several people should file such requests.
Secondly, while the two candidates are the only people who can ask for a recount, they are not the only people who can sue. Voters should start lining up lawsuits in state and federal court, trying to make sure these votes are not certified until their cases are heard. It seems to be that minority voters may have a federal case here.
Other voters should bring all kinds of legal action to bear in state or federal courts.
Remember how much the Supreme Court of the US claimed to be concerned about "equal protection" in Bush v. Gore? It seems to me that voters outside Waukesha county can sue to claim that Waukesha votes were treated differently than all others, and as a result there is an equal-protection violation (That was the linchpin of the SCOTUS decision: that since only some votes were getting manual counts, they were treated differently -- and therefore unequally -- from other votes).
Similarly, voters within Waukesha county should sue to make the same claim: that their votes were treated differently from those of voters in every other Wisconsin county, and as a result, there is an equal-protection violation there as well.
Voters can also file mandamus suits, which would compel various officials and agencies to do their duty under the law. For example, you might sue a district attorney's office or the state attorney general try to get them to begin criminal investigatives procedures.
You can probably think of a host of other officials who might have the legal authority to do something here but are not. They too should be targets of mandamus suits that would seek them to perform the duties of their offices.
I don't believe in using the legal system for trivial purposes. But it is important that all legal remedies be brought to bear now to slow down the process of getting this election certified until the questions raised by Ms. Niklaus's actions are answered.
