Not unexpected of course. This is possibly the most conservative circuit in the country and this is just to cause a circuit split and push this to the SCOTUS.

Without the text of the opinion this becomes a bit of speculation, but I'm sure Lopez is cited somewhere to try and discuss the limits of Commerce Power.
The big concern is if Justice Kennedy is prepared to begin a new era of Commerce Clause jurisprudence. CJ Marshall put us on the path of expansive commerce power that survived a good bit of time before the industrial revolution and Lochner.
Commerce power was not expanded until the New Deal and we've basically had unfettered commerce power in Congress up until Lopez and small chips around the edges during the Rehnquist Court.
If John Roberts can get Kennedy to chop down this individual mandate then we could be headed back to depression times for real with a giant blow to the federal commerce power. Right in time for the 2012 election too...
