WASHINGTON -- In a potentially momentous case, the Supreme Court will once again confront the issue of race in university admissions in an appeal brought by a white student denied a spot at the flagship campus of the University of Texas.
The court said Tuesday it will return to the issue of affirmative action in higher education for the first time since its 2003 decision endorsing the use of race as a factor in freshmen admissions. This time around, a more conservative court is being asked to jettison that ruling and outlaw affirmative action in the university setting.
It's expected that will happen around October this year. Luckily, the MSNBC article goes on to provide in depth analysis of how this might affect the upcoming presidential election as well as possible motivations for the timing. More after the squiggle.

They already call Obama the "Food Stamp President". Calling him the Food Stamp President in one breath, and the Affirmative Action President in the next will add a few decibels to that particular brand of dog whistle which we know the GOP will be blowing over the next few months.
This is beyond judicial activism. Judicial electioneering has to be at least a few levels lower in court official hell.
