A group of Paultroons have sued the RNC claiming collusion (not collision) with the Romney campaign. The 132 delgates represent 18 states and 5% of the total elected to the convention.
CNN reports the lawsuit alleges the rule that state delegations must vote for the candidate that won that state's primary or caucus violates federal law. This means delegates who support other candidates are enjoined from voting their conscience in violation of the Constitution. The lawsuit also alleges delegates supporting candidates other than Romney were subjected to harassment by the RNC and Republican state leaders. It consisted of violation of party rules, threats of violence and demands that delegates sign affidavits promising to vote for Romney.
My emphasis.
Now, the non-bolded part of the block quote seems to be standard "If I don't like the result of X, then X must violate the Constitution!" reasoning. However, the bolded part sounds like something that could get someone somewhere in trouble. IANAL, but the people who are supposed to enforce the rules not following the rules can and does lead to suits.
Paul's campaign is not party to the suit. The Paultroons are acting on their own.
CNN has more.
The legal filing, which names Priebus and GOP chairmen in every state as defendants, "seeks the guidance of the court" on whether the plaintiffs are free to break with certain state party rules and vote for the candidate of their choice at the August convention.
Ron Paul conceded Romney has the delegates to win the nomination, but is not yet ready to endorse Willard. I assume he's holding out for a better offer.
The primaries may be over but we still need popcorn!
