The Massachusetts high court continues to be one of the best in protecting the rights of marijuana users.
The Supreme Judicial Court of Massachusetts ruled that the police can't just raid a house suspected of growing marijuana without first checking to find out if the resident is a registered medical marijuana patient.
Will courts in other states follow along?
Police can still potentially find probable cause of they believe that the amount of the grow exceeds the "60 day supply" allowed under the 2012 Massachusetts Medical Marijuana Law.
The amount of a 60 day supply is preemptively 10 ounces, and presumably the number of plants necessary to produce that continuing supply.
It is also possible that a registered caregiver could be growing on behalf of multiple patients.
