Howdy, folks! Its's been quite ride since 3/22/15. Part One of saga here:
daily kos
Initial left hip fracture and left femur fracture set upon admission. Right hip fracture set 3 days later.
Left intubated in hopes of repairing left knee and ankle fractures ASAP.
Alas! Too much swelling! Plus, Mr. WH kept losing blood out of fractured femurs. He would receive more whole blood, and his lungs filled with fluid. So then he required diuresis.
Finally extubated April 1st. Still needs those 2 other surgeries on the left knee and ankle. But he improved enough to be moved to a post surgery floor while waiting.
Now comes the crux of the story: In NYS, a driver who is unconscious at scene of accident and unable to participate in filed sobriety test, or consent to breathalyzer, is presumed to be intoxicated. It will be months before the "legal" toxicology results are in, and I have not been able to obtain labs done upon admission last March.
The UTT, Uniform Traffic Ticket, says ticket is issued based on state trooper observations, smell of alcohol on breath. We know Mr. WH had a few beers over 5 hours, but he will not drive if he has been drinking more than that.
Now, here is the funny part. His roommate did not have a drop to drink, but he received the same UTT for DUI as Mr. WH!
This ties up your no fault insurance. Until the DUI is settled, after many months, no no fault insurance for you!
Have a nice day!
