Rowan County Clerk Kim Davis can't seem to get it through her head—marriage equality is the law of the land. Despite a clear legal setback to her "religious liberty" case yesterday, in which a judge
denied her request for a stay pending appeal:
The injunction operates not against Davis personally, but against the holder of her office of Rowan County Clerk. In light of the binding holding of Obergefell, it cannot be defensibly argued that the holder of the Rowan County Clerk’s office, apart from who personally occupies that office, may decline to act in conformity with the United States Constitution as interpreted by a dispositive holding of the United States Supreme Court. There is thus little or no likelihood that the Clerk in her official capacity will prevail on appeal.
This morning, longtime couple William Smith Jr. and James Yates again visited the Rowan County Clerk's office to get their marriage license and Kimberly Davis' office
again refused:
William Smith Jr. and James Yates strode Thursday morning into their county clerk's office for their third attempt to get a marriage license. The office of Rowan County Clerk Kim Davis once again denied them, despite an order from a federal appeals court issued hours earlier that upheld a judge's directive to issue the licenses.
Despite a clear ruling, in which the judge said her case had "little or no likelihood that the Clerk in her official capacity will prevail on her appeal," Davis is still refusing to carry out her duties as prescribed by law. As an elected official, she cannot be fired, but perhaps the people of Rowan County will be fed up enough to begin a recall effort.
