1-26-17: Standing Rock Sioux Tribe #StandAgainstDAPL // Breaking It Down
In December, the US Army Corps of Engineers declined to issue a final easement and instead called for the Dept. of the Army to conduct an Environmental Impact Statement (EIS) and explore a reroute. This order recognized that further review and research was required, before allowing Dakota Access & Energy Transfer Partners to drill.
The Department of the Army entered their intent to conduct the EIS into the Federal Register, which is a legal, official publication of the US Government that announces regulations, proposed rules, executive orders, proclamations and other presidential documents. Once the EIS has been registered, it becomes part of the official record, and it becomes enshrined in law that it must be conducted barring a significant change in circumstance. Additionally, the Army Corps’ Department of Public Works allows for a period of public comment, whereby citizens can express their opinion, offer feedback or make suggestions.
To date, nearly 40,000 people have submitted comments expressing concern about DAPL.
The President cannot grant an easement (as articulated in his Presidential Memo) - thus obliterating the process above - simply because he wants it. Additionally, the Army Corps lacks the authority to issue the easement because it has committed to the EIS process.
For these reasons, we maintain Trump’s Presidential Memo arbitrary and overreaching.

In this screenshot, you'll see that Comments are no longer accepted, although the Department of the Army originally said that comments would be accepted until February 20th.

New documents filed Monday in Dundon v Kirchmeier, our civil rights class action lawsuit against the Morton County Sheriff for police violence on Backwater Bridge on November 20. We filed 33 new Declarations, including one by a former Commissioner of the Baltimore Police Department who has also conducted independent investigations into law enforcement response to demonstrations in Ferguson, MO and was involved in overseeing court supervision of three major city police departments. He confirmed that law enforcement’s characterization of the Water Protector’s actions that night as a riot is is overstated and inaccurate and that deployment of these so-called “less lethal” weapons in fact constituted an unnecessary and inappropriate use of force by law enforcement.
