With his establishment of a religious test for refugees, Trump has now created an honest-to-God litmus test for his Supreme Court nominee.

His nominee (yes, sickening on multiple levels) MUST be able to state without equivocation that a religious test for refugees is patently, indisputably, straight-up unconstitutional. Any reference to circumstance, any hedge, any ground lost on that point must be utterly disqualifying. This must be, and will be of course, a major line of questioning, and a first bottom line. I hope it will be raised by a GOP Judiciary Committee member first, out of sheer decency.
Any nominee that cannot meet this most basic constitutional standard must not get to Day 2 of Judiciary Committee hearing.
