Major caveat: IANAL, IAAP and my legal understanding is quite different, but here goes.
1. Emoluments are illegal according to the Constitution.
2. There is no legal remedy for the crime, i.e. there is no punishment per code, meaning we have no idea what the sentence should be.
3. However, this is a monetary crime.
4. So, could the US Government sue Trump arguing that, since he cannot profit from being in office, that all money he gained from the government outside of expenses are the property of the US Government?
By all means, pay him for the expenses. However, wouldn’t discovery be great? Could you imagine the number of monetary crimes and corruption we would find in his books?
In addition, since this is a civil court issue, wouldn’t we just need 50%+1 on a jury, thus negating any Trumpers?
