Here’s the situation:
A cop stops a peaceful citizen going about his or her lawful business on an excuse, and then begins making illegal demands to which the citizen rightfully and politely refuses to comply with citing constitutional rights and appropriate laws. The assumption is that the citizen is actually and factually knowledgeable about such.
The cop then asserts that anything he orders is a lawful order and the citizen is obligated to comply without questioning his authority. The citizen again cites the Constitution and the laws, which angers the cop who moves into threatening bully mode and begins threatening arrest. The citizen demands to know what exactly he or she is being arrested for, but the cop ignores the question and demands immediate compliance and surrender.
The citizen refuse the illegal orders and the cop responds with violence, making the citizen fear for his or her life.
If the citizen is legally armed and has the appropriate credentials, and proceeds to shoot and kill the cop, would, or should, that citizen find succor in the “stand your ground laws”, citing imminent threat from an armed person acting irrationally and illegally, further citing the need to make a split-second decision in the heat of the moment, fearing for their life?
Would it make a difference if the cop was known to have killed others during arrests already?
