Per Article 2 Section 2:
The President … shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.
There is a problem with the word “in”. Is Trump now in a case of impeachment for which he cannot be pardoned, e.g., by Pence, were he to become president? Or, is he now prohibited from issuing pardons?
It has been noted that:
Bill Clinton was impeached on December 19, 1998.
On December 24, 1998, while “under impeachment,” he pardoned 33 people.
So, what, if anything, prevents Trump from issuing pardons to the insurrectionists who did his bidding last week?
