So, Attorney General Steve Marshall of the state of Alabama, in a truly vindictive way, wants to punish those who help women of Alabama get an abortion by going after anyone that “originates a conspiracy” to break Alabama laws against abortion within the state of Alabama. He wants to prosecute anyone that helps a person in Alabama get an abortion, if the conspiracy to do so occurred within Alabama.
Okay, what if the conspiracy originates in a state where abortion is legal. Let’s just say for instance that I create a YouTube video and offer my help to get an abortion for any woman living in Alabama and I post that video from the great state of California where abortion is still legal. Would I have then initiate the conspiracy from California? What if every person that wanted to help women travel for abortion and lived in a state where abortion was legal, did the same, would that qualify as initiating the conspiracy in a state where it was legal. What exactly constitutes the initiation of a conspiracy?
How about this, I set up a Robo-Call that originates from a state where abortion is still legal, and call every house in the state of Alabama and offer to assist them in securing transportation services for any woman that needs an abortion. Surely that would mean that the “conspiracy originated” in the state where it was legal. Am I right? Would that destroy little Steve Marshall’s plan to go after me?
See Stevie is so upset that women can travel out of his state to get an abortion, and he really hates that he can’t actually do anything about that. So, he wants to find any way that he can to prosecute anyone for anything related to abortion in the hopes of scaring women in his state and forcing them to become baby factories. Personally, I say hmmm, I bet we can piss you off some more buddy.
