Seriously, you can't make this stuff up.

Age of consent should be 13, says barrister

A prominent barrister specialising in reproductive rights has called for the age of consent to be lowered to 13.

Barbara Hewson told online magazine Spiked that the move was necessary in the wake of the Jimmy Savile scandal to end the "persecution of old men".

She also said that complainants should no longer receive anonymity.

source: BBC

Really, Ms. Hewson has more brass that every single member of the Tea Party... according to the BBC account, the barrister warns of "fetishising victimhood."

"What we have here is the manipulation of the British criminal justice system to produce scapegoats on demand. It is a grotesque spectacle," she said.

"It's time to end this prurient charade, which has nothing to do with justice or the public interest."

Truly, this stands on its own as cowardly, elitist, and ridiculous ... and I wonder how many of those in power are secretly applauding Hewson's offensive utterings.

Ms. Hewson, the grotesque spectacle is you and all those persecuted old men, those old masters of the universe who've not only defiled young children but the planet at large.

... the only surprising thing about this is that it was first suggested outside the US.  Neolibs would argue that this is an example of removing arbitrary government barriers and expanding the Marketplace of Consent to those that have been excluded - allowing for more choice from rational actors.  Libertarians would say that it is not the place of government to protect children.  Theocons would say that it is God's will for these young women to obey the wishes of the community elders plus it gives her more time to produce offspring.  Unless you're 'blah'.  Because we need more white babies.  Because our Middle Eastern-yet-totally-Caucasian-God said so.  Paleocons would say 'sex good..me want sex..me not care what woman say' or some such nonsense.

A tag is a way to search for this diary. If someone is searching for "Barack Obama," is this a diary they'd be trying to find?

Use a person's full name, without any title. Senator Obama may become President Obama, and Michelle Obama might run for office.

If your diary covers an election or elected official, use election tags, which are generally the state abbreviation followed by the office. CA-01 is the first district House seat. CA-Sen covers both senate races. NY-GOV covers the New York governor's race.

Tags do not compound: that is, "education reform" is a completely different tag from "education". A tag like "reform" alone is probably not meaningful.

Consider if one or more of these tags fits your diary: Civil Rights, Community, Congress, Culture, Economy, Education, Elections, Energy, Environment, Health Care, International, Labor, Law, Media, Meta, National Security, Science, Transportation, or White House. If your diary is specific to a state, consider adding the state (California, Texas, etc). Keep in mind, though, that there are many wonderful and important diaries that don't fit in any of these tags. Don't worry if yours doesn't.

specialize in trying to get pedophiles acquitted.

In the last 20 years, Mother Jones, Scientific American,  & as late as 2005, The Nation published articles denying the reality of a serious child sexual abuse problem in the US.  The Nation article was by a notorious pedophile defender who said that kids are damaged by our attitude & laws toward child porn.

Until I get further into my own recovery & can handle the topic a little better, I'll have to stop for now.

  •  Persecution or prosecution? (9+ / 0-)

13?  Really?  The average female body isn't ready for the potential consequences and complications of sexual activity, much less the emotional or mental competency to consent at 13.  You simply don't have the life experience to know what you're getting into at that age.

    •  interesting choice of the word, isn't it? (6+ / 0-)

Persecution really sets it up that the defiler is the victim and maybe the one needed to be prosecuted is the 13-year-old siren or maybe the parents should be prosecuted ...

whatever, it is entirely sick and the most important thing:

The average female body isn't ready for the potential consequences and complications of sexual activity, much less the emotional or mental competency to consent at 13.  You simply don't have the life experience to know what you're getting into at that age.

(actually a rare genre for me unless it is one that is hyped on accuracy and uses original sources, etc) about arranged marriages among the nobility in pre-Tudor England.

Although the marriages (proxy or otherwise) took place when the girls were as young as nine, consummation of the marriage was scrupulously avoided until the late teens when the young women were considered mature enough to handle the rigors of childbirth. Since many of these marriages were constructed to merge dynasties, the health and longevity of the young wife was actually given much consideration and regard.

There were exceptions - such as Edmund Tudor, who was so desperate for an heir that he deflowered his twelve-year-old child bride. She bore him a son, all right - but the experience left her unable to have any more children, ever.

That son grew up to be Henry VII....

          •  Margaret Tudor was a remarkable woman. (0+ / 0-)

Despite her traumatic experience with her husband, which did indeed make her unable to have more children, Margaret not only survived him (Edmund Tudor died of plague when she was 7 months pregnant), but also survived 3 subsequent husbands.

A brilliant scholar, Margaret founded 2 colleges in Cambridge, England. She was instrumental in scheming to bring her only son to the English throne by convincing her then-husband, Earl Stanley, to betray Richard III at Bosforth, thus sending his troops to Henry's cause while still on the battlefield.

Margaret must have had some affection for Edmund since years after his death, she specified in her will that she was to be buried next to him. Although it may have been that she already saw her son as a future king, and intended for his Tudor parents to be buried together. She lived to the ripe age - for the times - of 68.

Not trying to derail the topic here, and I certainly adamantly oppose any lowering of the age of consent. I just wanted to indulge my fascination with Margaret and provide a few more details I thought were interesting.

Britain's Conservative government and its austerity policies are persecuting old men, and old women, and children, and all those in between in gigantic numbers.  I wonder where Ms. Hewson's concern is for their actual persecution?

Decency, and its enforcer shame, seem to have disappeared from the emotional repertoire of our betters these days.  How to bring it back short of rolling out the tumbrils is the political conundrum of our time.

Low-Income Kids Report First Sexual Intercourse At 12 Years Of Age In New National Study

Aug. 19, 2009 — As a new mother herself, Brenda Lohman admits to being shocked by the results of a new study she co-authored. It found that among nearly 1,000 low-income families in three major cities, one in four children between the ages of 11 and 16 reported having sex, with their first sexual intercourse experience occurring at the average age of 12.77.

"So if 12 years was the average age here, that meant that some kids were starting at 10 or younger," said Lohman, an Iowa State University associate professor of human development and family studies (HDFS). "A handful of kids reported having sex as early as 8 or 9. We know from our follow-up interviews that one boy who reported having sexual intercourse for the first time at age nine had fathered four children by the time he was 18."

      •  " Delaware, the age of consent was only 7" (4+ / 0-)

        https://en.wikipedia.org/...

A small number of Italian and German states introduced an age of consent in the 16th century, setting it at 12 years. Towards the end of the 18th century, other European countries also began to enact age of consent laws. The first French Constitution established an age of consent of 11 years in 1791, which was raised to 13 in 1863. Portugal, Spain, Denmark and the Swiss cantons, initially set the age of consent at 10–12 years and then raised it to between 13 and 16 years in the second half of the 19th century.[3] Historically, the English common law set the age of consent to range from 10 to 12.[4]

In the United States, by the 1880s, most states set the age of consent at 10–12, and in one state, Delaware, the age of consent was only 7. A New York Times article states that it was still aged 7 in Delaware in 1895.[5] Female reformers and advocates of social purity initiated a campaign in 1885 to petition legislators to raise the legal age of consent to at least 16, with the ultimate goal to raise the age to 18. The campaign was successful, with almost all states raising the age of consent to 16–18 by 1920

In the 12th century Gratian, the influential founder of Canon law in medieval Europe, accepted age of puberty for marriage to be between 12 and 14 but acknowledged consent to be meaningful if the children were older than 7. There were authorities that said that consent could take place earlier. Marriage would then be valid as long as neither of the two parties annulled the marital agreement before reaching puberty, or if they had already consummated the marriage. It should be noted that Judges honored marriages based on mutual consent at ages younger than 7, in spite of what Gratian had said; there are recorded marriages of 2 and 3 year olds
        https://en.wikipedia.org/...
        Germany
The age of consent in Germany is 14, as long as a person over the age of 21 does not exploit a 14–15 year-old person's lack of capacity for sexual self-determination, in which case a conviction of an individual over the age of 21 requires a complaint from the younger individual; being over 21 and engaging in sexual relations with a minor of that age does not constitute an offense in and of itself.

        Italy
The age of consent in Italy is 14 years, with a close-in-age exception that allows those aged 13 to engage in sexual activity with partners who are less than 3 years older.

        Netherlands
Consensual sexual relations between adolescents who are close in age are not punished: sexual acts between persons who have reached the age of 12 years are widely tolerated by the courts and the Dutch Public Prosecution Service if the difference in age between the two partners is not too great. The latter is determined at the discretion of the court, though usually four years is deemed acceptable.

This whole subject is so complex and difficult ,
I've been reading about it for a long time trying to understand but the only thing I can say is that there is real problems all around this subject . People obviously have very strong opinions about it and some have crazy ideas like "7" or "at puberty" or never unless married .

So this is my option only, but the age of consent should never be below 17.  Adolescent girls, regardless of physical abilities, for the most part aren't mature enough mentally or socially to deal with the responsibility of sexual activity.  It seems to gets worse, between peer pressure and physical insecurities, as girls advance through high school.  Again, just my .02c as a father of a young girl.
